City Commission Minutes 8/06/2019

Regular Meeting:

 

The Governing Body of the City of Wamego, Kansas, met in Regular Session on Tuesday, August 6, 2019 at 6:00 P.M. in the City Commission Chambers at 430 Lincoln Avenue, Wamego, Kansas.  Those present were; Mayor Thomas Beem, Commissioners; Richard Weixelman, Leslie Dugan and Clifford Baughman.  Commissioner William Ditto was absent.

 

Also present were:  City Manager, Merl Page, City Clerk, Shanda Jahnke, and Assistant City Manager, Stacie Eichem.

 

The City Clerk presented the minutes of the regular meeting of the Governing Body held on July 16, 2019 and the special meeting held July 25, 2019.  After a careful reading and discussion thereof, it was moved by Commissioner Baughman and seconded by Commissioner Weixelman to approve the minutes as presented.  Motion carried.  Aye: 4, Nay: 0.   

 

The City Clerk then submitted to the Governing Body for their consideration and approval Appropriation Ordinance No. 1578.  After a careful review and discussion thereof, Commissioner Weixelman moved, seconded by Commissioner Baughman, to approve and adopt Appropriation Ordinance Number 1578.  Motion carried.   Aye: 4, Nay:  0. 

 

 

Public Comments and Communications:

 

Mayor Beem called for a special meeting on Thursday, August 15, 2019 at 6:00 P.M. to hold the 2020 Budget Hearing and the next regular work session will be held on Tuesday, August 20, 2019 at 4:30 P.M.

 

 

Ozfest Update/Request:

 

Daryn Soldan was present to request closing Lincoln Avenue from 4th Street to 6th Street and 5th Street on both sides of Lincoln Avenue to the alleys for the annual Oztoberfest on October 5th from 5AM to 8PM. Commissioner Baughman moved, seconded by Commissioner Dugan, to approve the street closures for the annual Oztoberfest. Motion carried.   Aye: 4, Nay:  0. 

 

At this time, the City Manager welcomed Scouts to the meeting, as they were working on a merit badge.

 

Tobacco Use Regulation Request:

 

This issue had been tabled from the last regular meeting. Richard and Lorraine Shermoen were present to request the Governing Body consider passing an ordinance changing the age to purchase tobacco products from 18 to 21 within the City, with support from Tim Winter, USD 320 Superintendent and a written letter from Steve Land, Wamego Health Center Director.  After a lengthy discussion, Mayor Beem moved to prohibit the sale of tobacco products to persons under the age of 21, with Commissioner Baughman seconding. Motion failed to pass.   Aye: 2, Nay:  2, with Commissioners Dugan and Weixelman voting nay.   

 

City Hall Façade Review/Update:

 

Bruce McMillan was present to update the Governing Body on repairing the City Hall façade. It would be Bruce McMillan’s recommendation after meeting with several specialists to repair and replace the existing façade with a design build negotiated contract to ensure a contractor with experience. The estimated cost of the repair and replace is $470,956. It was the recommendation of the City Manager to table this issue until the next regular meeting.  No objections, the issue was tabled.

 

Truck Parking Update:

 

Merl Page reported that the phone number he had been given for Union Pacific Railroad to discuss allowing tractor trailers on the leased property on 4th Street was not the correct number. He has left a message for the correct department but has not received a return call as of yet. He will keep the commission apprised of the situation but it appears at this time that most cities do not provide parking for tractor trailers. This issue had been tabled from a previous meeting.

 

Annexation Petition – Ordinance No. 1715:

 

The City Manager advised a petition had been received from Anne Fredrickson to annex in an area in Prairie Ridge. After a brief discussion, Commissioner Baughman moved to table this to allow for additional review regarding the HOA for the area in question. Commissioner Weixelman seconded the motion. Motion carried.   Aye: 4, Nay:  0. 

 

Back to School Run (Central Elementary):

 

Merl Page reported a request by Central Elementary for the Governing Body to approve the annual back to school run. Commissioner Baughman moved, seconded by Commissioner Dugan, to approve the annual back to school run.  Motion carried.   Aye: 4, Nay:  0. 

 

Ordinance No. 1716 – Standard Traffic Offense Code:

 

Ordinance No. 1716 was presented and reads as follows:

 

AN ORDINANCE OF THE GOVERNING BODY OF THE CITY OF WAMEGO, KANSAS, AMENDING PARAGRAPH 14-101 OF CHAPTER XIV. TRAFFIC, OF THE CODE OF THE CITY OF WAMEGO, KANSAS, INCORPORATING BY REFERENCE THE “2019 STANDARD TRAFFIC ORDINANCE FOR KANSAS CITIES, 47th EDITION”; AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH.

 

Ordinance No. 1717 – Uniform Public Offense Code:

 

Ordinance No. 1701 was presented and reads as follows:

 

AN ORDINANCE OF THE GOVERNING BODY OF THE CITY OF WAMEGO, KANSAS, AMENDING PARAGRAPH 11-101 OF THE CODE OF THE CITY OF WAMEGO, KANSAS, INCORPORATING BY REFERENCE THE “2019 UNIFORM PUBLIC OFFENSE CODE FOR KANSAS CITIES, 35th EDITION”; AND REPEALING ORDINANCE NO. 1701, AND ALL OTHER ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH.

 

Commissioner Dugan moved to approve Ordinance No. 1716 and Ordinance No. 1717. Commissioner Baughman seconded the motion. Motion carried. Aye: 4, Nay: 0.

  

Board Resignation - Planning Commission:

 

Merl Page reported that Carl Riblett had resigned from the Planning Commission. Commissioner Weixelman moved, seconded by Commissioner Baughman, to accept the resignation. Motion carried. Aye: 4, Nay: 0.

 

Board Appointment – Planning Commission:

 

Mayor Beem re-appointed Robert Owens to the Planning Commission with a term ending August 31, 2022.

 

Change Order – Aquatic Center:

 

The City Manager reported that the final change order for the aquatic center had been received for $9,900. Commissioner Baughman moved to accept the final change order for $9,900. Commissioner Dugan seconded the motion. Motion carried. Aye: 4, Nay: 0.

 

City Manager and Other Reports:

 

Merl reminded the Governing Body of the upcoming Budget hearing on August 15th at 6 P.M. and the upcoming work session on August 20th at 4:30 P.M.

 

There will be a KDOT consult meeting on August 26th with a follow up meeting in the fall.

 

County sales tax was up 1.8% and the City sales tax was up 7% compared to the same time frame from last year.

 

KS Government Journal and Ks Sampler photo books were included in the packet.

 

Mike King was present at the meeting to suggest ideas for the leaf and limb pile.
