City Commission Minutes 11/21/2017

Regular Meeting:

 

The Governing Body of the City of Wamego, Kansas, met in Regular Session on Tuesday, November 21, 2017, at 6:00 P.M. in the City Commission Chambers at 430 Lincoln Avenue, Wamego, Kansas. Those present were: Mayor William Ditto; Commissioners: Richard Weixelman, Clifford Baughman, Robert Morse Jr. and Thomas Beem.  

 

Also present were:  City Manager, Merl Page, City Clerk, Shanda Jahnke and Assistant City Attorney, Jacob Pugh.  

 

The City Clerk presented the minutes of the regular meeting of the Governing Body held on November 7, 2017.  After a careful reading and discussion thereof, it was moved by Commissioner Beem and seconded by Commissioner Baughman to approve the minutes as presented.  Motion carried.  Aye: 5, Nay: 0. 

 

The City Clerk then submitted to the Governing Body for their consideration and approval Appropriation Ordinance No. 1537.  After a careful review and discussion thereof, Commissioner Weixelman moved, seconded by Commissioner Morse, to approve and adopt Appropriation Ordinance Number 1537.  Motion carried.   Aye: 5, Nay:  0.

 

Public Comments and Communications:

 

Mayor Ditto called for a regular work session on Thursday, November 30, 2017 at 5:30 P.M.

 

The City Manager reported Doug Sellers (Wicked Marathon) agenda item and the audit presentation would be on the agenda for the next regular meeting in December.

 

Jessica Pope – Outdoor Concert:

 

Jessica Pope was present to request use of the Recreation Complex for an outdoor concert featuring the Irish Band, The High Kings, on September 2, 2018. The concert would require electricity and snow fencing. The proposed event would include food vendors and a beer garden. After a lengthy discussion, Commissioner Morse moved to table the request until the next regular meeting. Commissioner Beem seconded the motion. Motion carried.   Aye: 5, Nay:  0.

 

Power Supply Agreement - KMEA:

 

Neil Daney with KMEA was present to answer any questions regarding a proposed wind power supply agreement. This would be a 15 (fifteen) year agreement with a fixed rate. The City Manager felt this would be a beneficial power resource for the City. The Assistant City Attorney reviewed the contract and had no concerns. Resolution No. 20171121 was presented and read as follows:

 

A RESOLUTION OF THE CITY OF WAMEGO, KANSAS, AUTHORIZING THE EXECUTION OF THE BUCKEYE WIND FARM PROJECT AGREEMENT BETWEEN THE CITY OF WAMEGO, KANSAS, AND THE KANSAS MUNICIPAL ENERGY AGENCY; MAKING CERTAIN COVENANTS AND AGREEMENTS TO PROVIDE FOR THE PAYMENT AND SECURITY THEREOF AND AUTHORIZING CERTAIN OTHER DOCUMENTS AND ACTIONS IN CONNECTION THEREWITH.

 

Commissioner Morse moved to adopt Resolution Number 20171121.  Commissioner Baughman seconded the motion. Motion carried.   Aye: 5, Nay:  0.

 

Architect Agreement Amendment – Heritage Building:

 

Merl Page advised Steve Land, Hospital Director, had requested an amendment to the agreement with the architect with Bruce McMillan for the Heritage building to include interior design at a cost of $1,140 to sub contract that portion of the project. Commissioner Weixelman moved to authorize an amendment to the agreement to subcontract interior design at a cost of $1,140. Commissioner Morse seconded the motion. Motion carried.   Aye: 5, Nay:  0.

 

Annexation Request – City of Wamego & Custom Wood Products:

 

Ordinance No. 1688 was presented and read as follows:

 

AN ORDINANCE OF THE GOVERNING BODY OF THE CITY OF WAMEGO, KANSAS, ANNEXING A .92 ACRE (MORE OR LESS) TRACT OF LAND OWNED BY THE CITY OF WAMEGO, EXTENDING FROM THE CENTERLINE OF VALLEY STREET SOUTH TO THE KANSAS RIVER, ALONG THE WEST LINE OF THE NORTHWEST QUARTER OF SECTION 10, TOWNSHIP 10 SOUTH, RANGE 10 EAST OF THE 6TH P.M., IN POTTAWATOMIE COUNTY, KANSAS, EXTENDING THE CORPORATE LIMITS OF THE CITY OF WAMEGO, POTTAWATOMIE COUNTY, KANSAS; AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH.

 

It was moved by Commissioner Beem and seconded by Commissioner Baughman to adopt Ordinance No. 1688. Motion carried.  Aye: 5, Nay: 0. 

 

Ordinance No. 1689 was presented and read as follows:

 

AN ORDINANCE OF THE GOVERNING BODY OF THE CITY OF WAMEGO, KANSAS, ANNEXING A 25.16 ACRE TRACT OF LAND LOCATED AT THE NORTHEAST CORNER OF BALDERSON BOULEVARD AND VALLEY RD.,  EXTENDING THE CORPORATE LIMITS OF THE CITY OF WAMEGO, POTTAWATOMIE COUNTY, KANSAS; AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH.

 

Commissioner Baughman moved to approve Ordinance No. 1689. Commissioner Weixelman seconded the motion. Motion carried.  Aye: 5, Nay: 0. 

 

 

4th Street Modifications – Off Site Improvements:

 

The City Manager requested latitude to address some issues that have been created by the 4th Street Project to private drives. He explained that the pitch of some of the driveways has been changed dramatically due to the construction of the six foot wide sidewalk. He requested the authority to have City staff make on-site decisions to correct the issues.  Commissioner Weixelman approved authorizing City staff to make on-site decisions about correcting slope elevation adjacent to the sidewalks at a cost up to $5,000 per modification. Commissioner Morse seconded the motion.  Motion carried.  Aye: 5, Nay: 0.

 

4th Street Project –Change Order:

 

Merl Page advised an issue with the water line elevation at 6th Street and Parkview would have an additional cost of $3,875.  Commissioner Baughman moved to approve $3,875 to correct water line elevation. Commissioner Beem seconded the motion.  Motion carried.   Aye: 5, Nay:  0.

 

City Manager and Other Reports:

 

Phase I of the 4th Street Project should be concluding in the next few weeks. A portion of the intersection at Vintage will be opening.

 

Merl reported bids for the pool project were being sent out with the deadline of December 7th. A special meeting would be held December 12 to evaluate and consider bid approval. The suggested date to close the pool from the consultants is July 9, 2018, City staff disagreed due to scheduling issues. It was the staff’s recommendation to close the pool at the end of July 2018. Commissioner Weixelman moved to allow the pool be closed July 30, 2018 to begin construction of the new pool with a substantial completion date of May 31, 2019. Contractors can use the parking area on the south side of the park for staging.  Commissioner Beem seconded the motion. Motion carried.   Aye: 5, Nay:  0.

 

The City Manager reported an extension for Well Perfection was unnecessary as the original letter pertained to the airport well.

 

The Kansas Government Journal and a reminder of the upcoming leaders retreat was included in the Commission packets. The Board of Zoning appeals meetings will be held on the 4th Monday of each month instead of Tuesday. The Chamber of Commerce wants to have Red Raider Flags on the poles downtown. The City’s only responsibility would be in putting up and taking down the flags.

 

At this time, Commissioner Weixelman moved to adjourn into executive session for a period of ten (10) minutes to discuss attorney-client privilege related to potential litigation and the Commission meeting would reconvene at 7:13 PM.  Commissioner Baughman seconded the motion.  Motion carried.  Aye: 5, Nay:  0.

 

The meeting reconvened at 7:13 PM, whereupon , Commissioner Morse moved to adjourn into executive session for an additional five (5) minutes to discuss attorney-client privilege related to potential litigation and the Commission meeting would reconvene at 7:18 PM.  Commissioner Baughman seconded the motion.  Motion carried.  Aye: 5, Nay:  0.
