City Commission Minutes 09/19/2017

Regular Meeting:


The Governing Body of the City of Wamego, Kansas, met in Regular Session on Tuesday, September 19, 2017, at 6:00 P.M. in the City Commission Chambers at 430 Lincoln Avenue, Wamego, Kansas. Those present were: Mayor William Ditto; Commissioners: Richard Weixelman, Clifford Baughman, Robert Morse, Jr., and Thomas Beem.  


Also present were:  City Manager, Merl Page, Shanda Jahnke, City Clerk and Assistant City Attorney, Jake Pugh.  


The City Clerk presented the minutes of the regular meeting of the Governing Body held on September 5, 2017.  After a careful reading and discussion thereof, it was moved by Commissioner Baughman and seconded by Commissioner Weixelman to approve the minutes as presented.  Motion carried.  Aye: 5, Nay: 0. 


The City Clerk then submitted to the Governing Body for their consideration and approval Appropriation Ordinance No. 1533.  After a careful review and discussion thereof, Commissioner Morse moved, seconded by Commissioner Beem, to approve and adopt Appropriation Ordinance Number 1533.  Motion carried.   Aye: 5, Nay:  0.


Public Comments and Communications:


Mayor Ditto called for a regular work session on Tuesday, October 3, 2017 at 4:30 P.M.


The City Manager reported the Public Hearing for the CDBG grant had been duly published and the application was terminated due to Custom Woods changing locations from the Wamego Industrial Park to the corner of Valley and Balderson Blvd.


Parking Regulations – Industrial Park:


Merl Page requested the Governing Body table the issue of parking recommendations for the Industrial Park until a future meeting for further research. Commissioner Baughman moved to table Industrial Park parking recommendations until a future commission meeting. Commissioner Beem seconded the motion. Motion carried.  Aye:  5, Nay:  0.


Benefit District- Resolution of Advisability:


The City Manager reminded the Governing Body of the benefit district requested by Pottawatomie County EcoDevo had been tabled at the last regular meeting. He then requested the issue be table indefinitely to allow for additional time for EcoDevo to determine a plan for the area previously planned for Custom Woods. After some consideration, Mayor Ditto moved, seconded by Commissioner Beem, to table the issue of the Industrial Park Benefit District until a future meeting.  Motion carried.  Aye:  5, Nay:  0.


Personnel Policies:  


Merl Page reminded the Governing Body of the personnel policy that does not allow employees within the six month probationary period to use accrued vacation or sick time until after the probationary period has been successfully completed. Due to the requirements of the City’s health insurance carrier of employees being required to be compensated for a minimum of thirty (30) hours per week to qualify for insurance benefits, employees in the probationary are inadvertently having to pay additional premiums.  It is the staff’s recommendation to allow employees within the six month probationary period be allowed to use accrued vacation and/or sick time within the probationary period. Commissioner Morse moved and Commissioner Weixelman seconded to allow City employees within the six month probationary period to use accrued vacation and/or sick time.  Commissioner Morse amended the motion to include making the policy retroactive and refunding employees that had to pay additional premiums in the six month probationary period. Commissioner Baughman seconded the motion to amend. Motion carried. Aye: 5, Nay:  0. The vote on the entire motion including the amendment was held.    Motion carried. Aye: 5, Nay:  0.


Equipment Sales Bids - Cutie:


The City Manager reported two bids were received for the sale of the Parks Department Cutie Truckster. The high bid was from Don Ebert for $485.00. Commissioner Weixelman moved to accept Don Ebert’s bid of $485.00 for the Cutie Truckster. Commissioner Baughman seconded the motion. Motion carried. Aye: 5, Nay:  0.


Consultant Addendum – 4th Street:


Merl Page advised Schwab Eaton offered to conduct compaction and cylinder testing for the 4th Street Project on an as needed basis due to the City not having the equipment to conduct the testing in house. Commissioner Beem moved to approve the amended agreement with Schwab Eaton for compaction and cylinder testing. Commissioner Baughman seconded the motion.  Motion carried. Aye: 5, Nay:  0.


Equipment Review – Police Department:


The City Manager reported Chief Baker had received a letter from the Pottawatomie County Sheriff suggesting the City allow two dispatch terminals be added to the Wamego Police Dispatch Center – one being for the County and the other for the City. The Sheriff’s Office would absorb the costs if the City would forfeit the 911 funds the City receives to the County. He reported he would be meeting with the Chief, Sheriff and the County Administrator next week. He then asked for a special meeting on September 28th for the Governing Body to hear the results of the meeting and a decision regarding the 911 fees and proposed terminals. Commissioner Baughman moved to hold a special meeting in the City Commission Chambers at 5:30 P.M. on September 28, 2017. Commissioner Weixelman seconded the motion. Motion carried. Aye: 5, Nay:  0.


Cereal Malt Beverage- Pizza Hut:


Merl Page advised the Pizza Hut had been sold and the new owners would need a CMB license issued through the City. Commissioner Beem moved to authorize a Cereal Malt Beverage license for the new owners of Pizza Hut. Commissioner Weixelman seconded the motion. Motion carried Aye: 4, Nay: 0, Abstention: Mayor Ditto abstained. 



City Manager and Other Reports:


Merl Page reported the 4th Street Project has been delayed but is still progressing with the 2nd week of October ending the first phase of the project.


The City received a gold star for a 5% discount on workman compensation premiums for 2018.


The KS Government Journal and Library minutes, finances and statistics were included in the meeting packets.


He reported that Regional Suppers put on by the League would be coming up in the next several weeks.  The one closest would be in Lawrence on October 11th.  If anyone was interested in attending, they needed to contact him.


No further business appearing, meeting was adjourned.
