City Commission Minutes 09/15/2020

The Governing Body of the City of Wamego, Kansas, met in a Regular Session on Tuesday, September 15, 2020 at 6:00 P.M. in the City Commission Chambers at 430 Lincoln Avenue, Wamego, Kansas.  Those present were: Commissioners: Thomas Beem, William Ditto and Clifford Baughman. Mayor: Richard Weixelman.  Leslie Dugan was present via zoom.

 

Also present were:  City Manager, Stacie Eichem, Assistant City Attorney Jake Pugh and City Clerk, Shanda Jahnke.

 

The City Clerk presented the minutes of the regular meeting of the Governing Body held on September 01, 2020 and special meeting minutes from September 03, 2020. After a careful reading and discussion thereof, it was moved by Commissioner Baughman and seconded by Commissioner Ditto to approve the minutes as presented. Motion carried.  Aye: 5, Nay: 0.   

 

The City Clerk then submitted to the Governing Body for their consideration and approval Appropriation Ordinance No. 1605.  After a careful review and discussion thereof, Commissioner Beem moved, seconded by Commissioner Baughman, to approve and adopt Appropriation Ordinance Number 1605.  Motion carried.   Aye: 5, Nay: 0. 

 

Public Comments and Communications:

 

The next regular work session will be Tuesday, October 06, 2020 at 4:30 P.M.

 

Covid-19 Updates and Restrictions:

 

The City Manager reported that we are still following KDHE and CDC guidelines. The outdoor pool had to close a day early and the indoor pool opening was delayed until September 21st.

 

4th Street Parking:

 

This issue had been tabled from the previous meeting. The City Manager reported receiving calls regarding parking on 4th Street.  The calls were requesting the Governing Body review parking on the north side 4th Street. She advised that letters had been sent to the residents in the area between Spruce Street and Columbian Road to advise of the issue and meeting. Two residents sent in opinions on the issue, one for parking and one against parking on 4th Street. After a brief discussion, Commissioner Baughman moved, seconded by Commissioner Beem to abolish parking on the north side of 4th Street between Spruce Street and Columbian Road. Motion carried.   Aye: 5, Nay: 0. 

 

Homecoming Parade Review:

 

Dwight Faulkner and Tim Winter were present to discuss the presented homecoming parade on September 25th from 2:00 PM-3:30 PM. At the last regular meeting, Commissioner Beem had requested this issue be put back on the next agenda. The parade would be a student activity on Lincoln Avenue to allow for more room for social distancing than they have at the school.   KDOT requires City approval to host such an event on a State Highway.  The school is asking for help from the City in blocking off Lincoln Avenue. Commissioner Beem asked Dwight and Tim to please discourage additional people from attending the parade. This issue was passed at the previous meeting, no motions necessary.

 

Abatement Update:

 

Stacie Eichem reported that the abatement of the house on the 700 block of Ash had occurred the previous Saturday without issue. Shane Geddry, Code Enforcement Officer, gave the property owner until after the city-wide garage sale this coming weekend to clean up the remaining items.

 

Ordinance No. 1735 - Public Offense Code:

 

Ordinance No. 1735 was presented and read as follows:

 

AN ORDINANCE OF THE GOVERNING BODY OF THE CITY OF WAMEGO, KANSAS, AMENDING PARAGRAPH 11-101 OF THE CODE OF THE CITY OF WAMEGO, KANSAS, INCORPORATING BY REFERENCE THE “2020 UNIFORM PUBLIC OFFENSE CODE FOR KANSAS CITIES, 36th EDITION”, AMENDING SAID UNIFORM PUBLIC OFFENSE CODE TO RETAIN A PROHIBITION UPON SELLING, GIVING OR FURNISHING CIGARETTES OR TOBACCO PRODUCTS TO A PERSON UNDER 21 YEARS OF AGE; AND REPEALING ORDINANCE NO. 1718, AND ALL OTHER ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH.

 

Commissioner Baughman moved, seconded by Commissioner Beem to approve Ordinance No. 1735. Motion carried.  Aye: 5, Nay: 0. 

 

Ordinance No. 1736 – Standard Traffic Ordinance Amendment:

 

AN ORDINANCE OF THE GOVERNING BODY OF THE CITY OF WAMEGO, KANSAS, AMENDING PARAGRAPH 14-104 OF CHAPTER XIV. TRAFFIC, OF THE CODE OF THE CITY OF WAMEGO, KANSAS, UPDATING THE LISTING OF CITY OF WAMEGO STREETS HAVING SPEED LIMITS THAT DIFFER FROM THOSE PRESCRIBED UNDER SUBSECTION (a) OF SECTION 33, ‘MAXIMUM SPEED LIMITS.’ OF THE “STANDARD TRAFFIC ORDINANCE”, INCORPORATED BY REFERENCE UNDER PARAGRAPH 14-101 OF SAID CODE; AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH.

 

The City Manager also reminded the Governing Body that there was an ordinance prohibiting overnight parking by tractor/trailers on City streets. Commissioner Ditto moved, seconded by Commissioner Baughman to approve Ordinance No. 1736. Motion carried.  Aye: 5, Nay: 0. 

 

Audit Engagement Letter:

 

The City Manager advised the audit engagement letter had been received from Sink, Gordon and Associates. Commissioner Ditto moved to sign the audit engagement letter with Sink, Gordon and Associates. Commissioner Baughman seconded the motion. Motion carried.  Aye: 5, Nay: 0. 

 

T. Russel Reitz Contract:

 

Stacie Eichem reported a contract from T. Russell Reitz had been received for the City to continue to take stray dogs to the T. Russell Reitz facility. Since March the City had taken two dogs to the facility. Commissioner Baughman moved, seconded by Commissioner Beem to approve contracting with T. Russell Reitz contingent upon City Attorney approval. Motion carried.  Aye: 5, Nay: 0.

 

Water/Sewer Project – Change Order:

 

The City Manager reported a second change order for the water/sewer project on Valley had been received which made the total project cost $2,469,259.57, which was less than the original price. Commissioner Baughman moved to accept change order of $47,815.57. Commissioner Ditto seconded the motion. Motion carried.  Aye: 5, Nay: 0.

 

4th Street Storm Sewer Agreement:

 

Stacie Eichem advised the original contract with Olsson for the 4th Street Storm Sewer project did not include inspections and reports. A new contract for inspections and reports through the completion of the project would be at a cost of $23,175. Commissioner Ditto moved, seconded by Commissioner Baughman to sign a contract with Olsson for remainder of the project. Motion carried.  Aye: 5, Nay: 0.

 

Kansas League of Municipalities Voting Delegates:  

 

The City Manager advised the Governing Body that the City needed to designate voting delegates for the Kansas League of Municipalities Annual Conference in October, which will be online this year.  Commissioner Baughman moved to have City Manager, Stacie Eichem and City Clerk, Shanda Jahnke be the voting delegates. Commissioner Beem seconded the motion.  Motion carried.  Aye: 5, Nay: 0.

 

Purchase Request – Public Library:

 

Stacie Eichem reported two proposals had been received to replace the HVAC system at the Library. A proposal was received from P.K. Mechanical for $10,101 and one from PCI for $16,900. Commissioner Beem moved, seconded by Commissioner Ditto to accept the proposal from P.K. Mechanical for $10,101. Motion carried.  Aye: 5, Nay: 0.

 

Department Update – Aquatic Center:

 

The City Manager reported the indoor pool was scheduled to open on September 21st and she is hoping to keep it open through the winter.

 

City Manager and Other Reports:

 

The City Manager reported the work on City Hall façade is close to being finished.  The 4th Street Storm Sewer project should be starting within the next week.

 

At this time, Mayor Weixelman moved to adjourn into executive session for a period of five (5) minutes to discuss potential land acquisition with the meeting reconvening at 6:35 P.M.  Commissioner Baughman seconded the motion.  Motion carried.  Aye: 5, Nay: 0.

 

The meeting reconvened at 6:35 P.M.

 

Commissioner Baughman moved to adjourn the meeting. Commissioner Ditto seconded the motion. Motion carried.  Aye: 5, Nay: 0
