City Commission Minutes 09/03/2019

Regular Meeting:

 

The Governing Body of the City of Wamego, Kansas, met in Regular Session on Tuesday, September 03, 2019 at 6:00 P.M. in the City Commission Chambers at 430 Lincoln Avenue, Wamego, Kansas.  Those present were; Mayor Thomas Beem, Commissioners; Richard Weixelman, Leslie Dugan, Clifford Baughman and William Ditto.  

 

Also present were:  City Manager, Merl Page, City Clerk, Shanda Jahnke, Assistant City Manager, Stacie Eichem, and Assistant City Attorney, Jake Pugh.

 

The City Clerk presented the minutes of the regular meeting of the Governing Body held on August 20, 2019.  After a careful reading and discussion thereof, it was moved by Commissioner Ditto and seconded by Commissioner Weixelman to approve the minutes as presented.  Motion carried.  Aye: 5, Nay: 0.   

 

The City Clerk then submitted to the Governing Body for their consideration and approval Appropriation Ordinance No. 1580.  After a careful review and discussion thereof, Commissioner Baughman moved, seconded by Commissioner Dugan, to approve and adopt Appropriation Ordinance Number 1580.  Motion carried.   Aye: 5, Nay:  0. 

 

Public Comments and Communications:

 

The next regular work session will be held on Tuesday, September 17, 2019 at 4:30 P.M.

 

Amendment – Architect Agreement:

 

Merl Page advised that an addendum to the architect agreement for the original investigation for the City Office building deterioration would include up to 10% of the actual construction cost.  Commissioner Ditto moved, seconded by Commissioner Dugan to accept the addendum to the original contract with McMillan Architects. Motion carried.   Aye: 5, Nay:  0. 

 

Street Improvements – Kaw Valley Road:  

 

The City Manager reported he had received two proposals for a 2-inch overlay on Kaw Valley Road from Highway 24 to Say Road. Bettis Asphalt had a proposal of $96303.75 and Schilling had a proposal of $50,400.00. It was the staff recommendation to accept the Schilling proposal of $50,400 with the work being completed on a Friday or Saturday. Commissioner Baughman moved to accept the Schilling proposal. Commissioner Weixelman seconded the motion.  Motion carried.   Aye: 5, Nay:  0. 

 

Ordinance No. 1718:  

 

This ordinance had been tabled from the previous two meetings for further information. Ordinance No. 1718 was presented and read as follows:

 

AN ORDINANCE OF THE GOVERNING BODY OF THE CITY OF WAMEGO, KANSAS, AMENDING PARAGRAPH 11-101 OF THE CODE OF THE CITY OF WAMEGO, KANSAS, INCORPORATING BY REFERENCE THE “2019 UNIFORM PUBLIC OFFENSE CODE FOR KANSAS CITIES, 35th EDITION”, AMENDING SAID UNIFORM PUBLIC OFFENSE CODE TO PROHIBIT SELLING, GIVING OR FURNISHING CIGARETTES OR TOBACCO PRODUCTS TO A PERSON UNDER 21 YEARS OF AGE; AND REPEALING ORDINANCE NO. 1701, AND ALL OTHER ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH.

  

Commissioner Baughman moved, seconded by Commissioner (Mayor) Beem to approve Ordinance No. 1718. Motion carried.   Aye: 5, Nay:  0. 

 

Ordinance No. 1715 – Annexation:

 

This ordinance was tabled from the previous meeting for further information. Ordinance No. 1715 was presented and read as follows:

 

AN ORDINANCE OF THE GOVERNING BODY OF THE CITY OF WAMEGO, KANSAS, ANNEXING LOT 15, PRAIRIE RIDGE ADDITION, POTTAWATOMIE COUNTY, KANSAS, EXTENDING THE CORPORATE LIMITS OF THE CITY OF WAMEGO, POTTAWATOMIE COUNTY, KANSAS; AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH.

 

Commissioner Weixelman moved to approve Ordinance No. 1715. Commissioner Ditto seconded the motion. Motion carried.   Aye: 5, Nay:  0. 

 

Ordinance No. 1719 – rezoning (R-H to R-2):

 

Ordinance No. 1719 was presented and read as follows:

 

AN ORDINANCE OF THE GOVERNING BODY OF THE CITY OF WAMEGO, KANSAS, REZONING A TRACT OF LAND, LOCATED AT 308 MAPLE STREET IN WAMEGO, FROM R-H: HISTORIC TOWNSITE RESIDENTIAL DISTRICT, TO R-2:  TWO-FAMILY DWELLING DISTRICT; AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH.

 

Commissioner Baughman moved to approve Ordinance No. 1719. Commissioner Weixelman seconded the motion. Motion carried.   Aye: 5, Nay:  0. 

 

EMG Contract – Agreement Modification:

 

Merl Page reported that the City had been in contract with EMG (energy consultants) since 2006. EMG has been purchased by Priority Power Management and will require a new agreement acknowledging the new ownership. The principals would still be the same with Greg Wright staying on with the new owners. This agreement would be retroactive back to September 1, 2019. Commissioner Ditto moved to approve signing with Priority Power Management contingent upon City Attorney review. Commissioner Baughman seconded the motion. Motion carried.   Aye: 5, Nay:  0. 

 

Industrial Commerce Route Agreement:

 

The City Manager reported that the original administration construction agreement with Olsson didn’t negotiate for the certified LPA inspector. The new or amended contract will be received at a later date. Commissioner Weixelman moved to accept the amended contract when received. Commissioner Baughman seconded the motion.  Motion carried.   Aye: 5, Nay:  0. 

 

Board Appointment(s) – Construction Board of Appeals:

 

Mayor Beem re-appointed Eric Artzer, Justin Vieux and Charles Davies to the Construction Board of Appeals whose terms will expire on September 3, 2022.

 

Establish Restricted Reserves:

 

Merl Page advised the Governing Body that establishing restricted funds for the Kirkpatrick funds would allow transparency, better tracking and easier utilization of funds. Commissioner Baughman moved, seconded by Commissioner Dugan to authorize restricting the Kirkpatrick funds. Motion carried.   Aye: 5, Nay:  0. 

 

Interim City Manager:

 

Commissioner Ditto moved to appoint Assistant City Manager, Stacie Eichem, as the Interim City Manager. Commissioner Baughman seconded the motion. Motion carried.   Aye: 5, Nay:  0. 

 

Commissioner Weixelman moved, seconded by Commissioner Baughman to increase Stacie Eichem’s salary to $6000 per month. Motion carried.   Aye: 5, Nay:  0. 

 

Limb Pick Up:

 

Merl Page reported MCM was leaving the temporary limb pile at their plant south of Wamego open until the fall. Commissioner Baughman moved to authorize the City crews to pick up limbs on the curbs from the storm on August 30th until Friday, September 13, 2019. Commissioner Dugan seconded the motion. Motion carried.   Aye: 5, Nay:  0. 

 

City Manager and Other Reports:

 

KS Government Journal was included in the packets.

 

Aquatic Center ribbon cutting will be September 05th at 9:15 A.M.

 

Annual League Conference reminder.

 

Merl reported the Governing Body had been invited to the Bluestem open house on September 16th

Merl had received an email that Westar was rebuilding the line from Alma and the City might need to run at the power plant.

 

City sales tax was up 2.9% and County was up .4%

 

At this time, Commissioner Baughman moved to adjourn into executive session for a period of fifteen (15) minutes to discuss potential acquisition of property and potential litigation with the meeting reconvening at 7:02 P.M.  Commissioner Ditto seconded the motion.  Motion carried.  Aye: 5, Nay: 0.

 

The meeting reconvened at 7:02 P.M.
