City Commission Minutes 12/20/2016

 

Regular Meeting:

 

The Governing Body of the City of Wamego, Kansas, met in Regular Session on Tuesday, December 20, 2016, at 6:00 P.M. in the City Commission Chambers at 430 Lincoln Avenue, Wamego, Kansas. Those present were: Mayor Clifford Baughman; Commissioners: Victor Enns, William Ditto, Robert Morse Jr. and Thomas Beem.  

 

Also present were:  City Manager, Merl Page, City Clerk, Shanda Jahnke and Assistant City Attorney, Jake Pugh.  

 

The City Manager presented the minutes of the regular meeting of the Governing Body held on December 6, 2016.  After a careful reading and discussion thereof, it was moved by Commissioner Morse and seconded by Commissioner Ditto to approve the minutes as presented.  Motion carried.  Aye: 5, Nay: 0. 

 

The City Clerk then submitted to the Governing Body for their consideration and approval Appropriation Ordinance No. 1515.  After a careful review and discussion thereof, Commissioner Enns moved, seconded by Commissioner Beem, to approve and adopt Appropriation Ordinance Number 1515.  Motion carried.   Aye: 5, Nay:  0.

 

Public Comments and Communications:

 

Mayor Baughman opened a public hearing regarding the vacation of Shanote Lane. Ordinance No. 1670 was presented and read as follows:

 

AN ORDINANCE OF THE GOVERNING BODY OF THE CITY OF WAMEGO, KANSAS, VACATING SHANOTE LANE, AS DEPICTED ON THE FINAL PLAT OF WAMEGO INDUSTRIAL PARK ADDITION, UNIT THREE, AN ADDITION IN THE CITY OF WAMEGO, KANSAS; AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH.

 

There was no objects expressed by the public regarding this request.

 

At this time, Commissioner Ditto moved to approve Ordinance No. 1670 vacating Shanote Lane. The motion was seconded by Commissioner Morse. Motion carried.   Aye: 5, Nay:  0.

 

Mayor Baughman called for a regular work session on Tuesday, January 3, 2017 at 4:30 P.M.

 

Communications Equipment – Police Department:

 

The City Manager requested this issue be tabled until the next regular meeting in January. Commissioner Enns moved to table this issue until the January 3, 2017 regular meeting. Commissioner Beem seconded the motion. Motion carried.   Aye: 5, Nay:  0.

 

Ordinance No. 1671 - Annexation:  

 

The City Manager presented Ordinance No. 1671 which reads as follows:

 

AN ORDINANCE OF THE GOVERNING BODY OF THE CITY OF WAMEGO, KANSAS, ANNEXING A 2.47 ACRE TRACT OF LAND, ADJOINING AND SOUTH OF LOT 39, WAMEGO INDUSTRIAL PARK UNIT FOUR, AN ADDITION IN THE CITY OF WAMEGO, KANSAS, AND ADJOINING AND EAST OF LOTS 34, 35, 36 AND 37, WAMEGO INDUSTRIAL PARK UNIT THREE, AN ADDITION IN THE CITY OF WAMEGO, KANSAS, EXTENDING THE CORPORATE LIMITS OF THE CITY OF WAMEGO, POTTAWATOMIE COUNTY, KANSAS; AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH.

 

Commissioner Morse moved to approve Ordinance No. 1671. Commissioner Enns seconded the motion. Motion carried. Aye: 5, Nay: 0.

 

Service Territory Review (Bluestem):

 

The City Manager reported a request had been made by Bluestem Electric to serve their new building within the City of Wamego’s service territory. Commissioner Ditto moved to authorize the City Manager, City Clerk and Mayor to sign the necessary paperwork to register with the Kansas Corporation Commission and allow Bluestem Electric to provide electricity to their new location within the City of Wamego service territory. Commissioner Morse seconded the motion.

Motion carried. Aye: 5, Nay:  0.

Resolution 20161220 – Territorial Limits of the City:  

 

Resolution No. 20161220 was presented which outlines the new corporate limits of the City of Wamego after the annexation of an area of east of the Industrial Park. Commissioner Ditto moved to approve Resolution No. 20161220 outlining the corporate territorial limits of the City of Wamego.  Commissioner Morse seconded the motion.  Motion carried.   Aye: 5, Nay:  0. 

 

Ordinance No. 1672 – Final Plat:

 

The City Manager reported that the Planning Commission had unanimously approved the proposed replat of 1200 & 1202 3rd Street and recommended the Governing Body approve the variance of the 1% of additional lot coverage for Lot 2 of the replat.  Commissioner Beem moved to approve Ordinance No. 1672 which read as follows:

 

AN ORDINANCE OF THE GOVERNING BODY OF THE CITY OF WAMEGO, KANSAS, APPROVING AND ACCEPTING THE “REPLAT OF LOT 208 WAMEGO ORIGINAL TOWNSITE CITY OF WAMEGO, KANSAS”; AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH.

 

Commissioner Enns seconded the motion. Motion carried. Aye: 5, Nay: 0.

 

Ordinance No 1673 – Liquor Licenses:

 

Ordinance No. 1673 was presented amending the license fees and renewal dates for all liquor licenses. The ordinance reads as follows:

 

AN ORDINANCE OF THE GOVERNING BODY OF THE CITY OF WAMEGO, KANSAS, AMENDING PARAGRAPHS 3-302, 3-402, 3-502, AND 3-602 OF CHAPTER III. BEVERAGES, OF THE CODE OF THE CITY OF WAMEGO, KANSAS, CHANGING THE OCCUPATIONAL TAX CHARGED BY THE CITY FOR RETAIL SALE OF ALCOHOLIC LIQUORS BY THE PACKAGE, AND THE LICENSE FEE FOR PRIVATE CLUB, DRINKING ESTABLISHMENT OR CATERER SALE OF ALCOHOLIC LIQUOR WITHIN THE CITY OF WAMEGO, KANSAS; AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH.

 

Commissioner Morse moved to approve Ordinance No. 1673.  Commissioner Enns seconded the motion. Motion carried. Aye: 5, Nay: 0.

 

Cereal Malt Beverage Licenses (2017):

 

The Governing Body reviewed the 2017 CMB Licenses for approval:

 

Gene’s Heartland                    Haag Oil/Red Raider Express            Last Stop

Leiszler Oil/Short Stop            Hart Management/Pizza Hut              Imperial Palace

 

 

Commissioner Enns moved to approve the 2017 CMB License applications contingent upon review by the Chief of Police and the Fire Chief. The motion was seconded by Commissioner Beem.  Motion carried.  Aye: 5, Nay: 0.

 

2017 Pay Plan Review:

 

Merl Page advised the Governing Body it would be his recommendation for part time, full time and salaried employees, excluding the City Manager, be eligible for a of 3% merit increase if an employee has an annual evaluation that exceeds expectations and a 3.5 % merit increase if the employee has an outstanding annual evaluation.   Commissioner Ditto moved to accept the pay schedule recommended by the City Manager. Commissioner Morse seconded the motion.  Motion carried.   Aye: 5, Nay:  0. 

 

Equipment Review – Power Plant:

 

The City Manager reported proposals for a battery system for the power plant had been received. This type of battery system would allow the first engine to be started in the case of a complete power outage, which would then allow for all of the power plant engines to be started. The proposals ranged from $11,650 to $22,500. It was the staff’s recommendation to accept the proposal for $11,650 and a unit to recharge the battery unit at a cost of $3,920. Commissioner Enns moved to authorize the purchase of a battery system and recharging unit for the power plant at a combined cost of $15,570.  Commissioner Beem seconded the motion.  Motion carried.   Aye: 5, Nay:  0. 

 

Equipment Review – Public Works:

 

Merl Page advised funds had been budgeted to replace a truck in the public works department that had been damaged several years ago. The City has the opportunity to purchase a 2016 ¾ ton pickup for $32,980. Commissioner Morse moved to authorize the purchase of a 2016 ¾ ton pickup for the public works department. Commissioner Ditto seconded the motion. Motion carried. Aye: 5, Nay: 0.

Flint Hills Regional Council renewal:

 

Commissioner Enns moved to renew the City of Wamego membership for 2017 in the Flint Hills Regional Council. Commissioner Ditto seconded the motion. Motion carried. Aye: 5, Nay: 0.

 

City Manager and Other Reports:

 

The City Manager reminded the Governing Body of the Leaders Retreat January 20th and 21st, as well as Local Government Day January 25th. He also reported the bronze statue in the park is one of the pictures on the 8 Wonders of Kansas brochure.

 

At this time, Commissioner Morse moved to adjourn into executive session for a period of twenty (20) minutes to discuss confidential data relating to financial affairs or trade secrets of corporations, partnerships, trusts, individual proprietorships and the Commission would reconvene at 6:51 PM.  Commissioner Beem seconded the motion.  Motion carried.  Aye: 5, Nay:  0.

 

The Mayor called the meeting back to order at 6:51 PM.
