City Commission Minutes 10/03/2017

Regular Meeting:

 

 

The Governing Body of the City of Wamego, Kansas, met in Regular Session on Tuesday, October 3, 2017, at 6:00 P.M. in the City Commission Chambers at 430 Lincoln Avenue, Wamego, Kansas. Those present were: Mayor William Ditto; Commissioners: Richard Weixelman, Clifford Baughman and Thomas Beem.  Commissioner Robert Morse, Jr. was absent.

 

Also present were:  City Manager, Merl Page, Shanda Jahnke, City Clerk and Assistant City Attorney, Jake Pugh.  

 

The City Clerk presented the minutes of the regular meeting of the Governing Body held on September 19, 2017 and the special meeting on September 28, 2017.  After a careful reading and discussion thereof, it was moved by Commissioner Baughman and seconded by Commissioner Beem to approve both sets of minutes as presented.  Motion carried.  Aye: 4, Nay: 0. 

 

The City Clerk then submitted to the Governing Body for their consideration and approval Appropriation Ordinance No. 1534.  After a careful review and discussion thereof, Commissioner Weixelman moved, seconded by Commissioner Beem, to approve and adopt Appropriation Ordinance Number 1534.  Motion carried.   Aye: 4, Nay:  0.

 

Public Comments and Communications:

 

Mayor Ditto called for a regular work session on Tuesday, October 17, 2017 at 4:30 P.M.

 

The Governing Body recognized Richard Brazzle, Electric Distribution Supervisor, for forty (40) years of continuous work for the City of Wamego.

 

Hazel Douglas was present to discuss street repair throughout the City. She stated several pot holes had been marked for a long period of time and not fixed. The City Manager explained the equipment used to patch had broken down. After the parts were received the equipment was repaired and the patching projects had been started. He also stated the City has a Street Advisory Committee that evaluates and recommends street projects as well. Several streets have been overlaid or reconstructed in the past several years with more to come.

 

Equipment Review- 911 System:

 

Merl Page reported after meeting with Chief Baker and Sheriff Riat it was suggested that a joint task force of emergency personnel be appointed to discuss and recommend a long range vision for emergency service communications. The Governing Body by general consensus agreed a task force collaborating on emergency service communications City and/ or County wide would be advisable

 

Ordinance No. 1685 – Standard Traffic Offense Code:

 

Ordinance No. 1685 was presented and reads as follows:

 

AN ORDINANCE OF THE GOVERNING BODY OF THE CITY OF WAMEGO, KANSAS, AMENDING PARAGRAPH 14-101 OF CHAPTER XIV. TRAFFIC, OF THE CODE OF THE CITY OF WAMEGO, KANSAS, INCORPORATING BY REFERENCE THE “2017 STANDARD TRAFFIC ORDINANCE FOR KANSAS CITIES, 45th EDITION”, AMENDING SAID STANDARD TRAFFIC ORDINANCE TO PROHIBIT J TURNS;  AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH.

 

Commissioner Baughman moved to approve Ordinance No. 1685. Commissioner Weixelman seconded the motion. Motion carried. Aye: 4, Nay: 0.

 

Ordinance No. 1686 – Uniform Public Offense Code:

 

Ordinance No. 1686 was presented and reads as follows:

 

AN ORDINANCE OF THE GOVERNING BODY OF THE CITY OF WAMEGO, KANSAS, AMENDING PARAGRAPH 11-101 OF THE CODE OF THE CITY OF WAMEGO, KANSAS, INCORPORATING BY REFERENCE THE “2017 UNIFORM PUBLIC OFFENSE CODE FOR KANSAS CITIES, 33rd  EDITION”; AND REPEALING ORDINANCE NO. 1665, AND ALL OTHER ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH.

 

Commissioner Beem moved to approve Ordinance No. 1686. Commissioner Baughman seconded the motion. Motion carried. Aye: 4, Nay: 0.

 

Rezoning – C-S to R-3 (1800 Farrell Drive):  

 

Merl Page reported the Planning Commission unanimously approved rezoning a portion of land behind 1800 Farrell Drive from C-S to R-3.

 

Ordinance No. 1687 was presented and reads as follows:

 

AN ORDINANCE OF THE GOVERNING BODY OF THE CITY OF WAMEGO, KANSAS, REZONING A .429 ACRE TRACT IN LOT 5, WEST HIGHWAY 24 UNIT TWO ADDITION TO THE CITY OF WAMEGO, KANSAS, LOCATED NORTH OF 1800 FARRELL DRIVE IN THE CITY OF WAMEGO, FROM C-S: HIGHWAY SERVICE DISTRICT, TO R-3:  MULTIPLE-FAMILY DWELLING DISTRICT; AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH.

 

Commissioner Baughman moved to approve Ordinance No. 1687. Commissioner Weixelman seconded the motion. Motion carried. Aye: 4, Nay: 0.

 

Appointments – FEMA Working Group:

 

Paul Odell and Clark Balderson were appointed by Mayor Ditto to the FEMA working group.

 

Equipment Review – Skid Steer Rotation:

 

The City Manager advised it is time for the annual rollover for the skid steer that the City has with KanEquip. With the hours on the current skid steer, the rollover will cost the City $2,600, which is within the budgeted amount. It is the staff’s recommendation to renew the lease.  Commissioner Baughman moved to renew the lease with KanEquip. Commissioner Beem seconded the motion.  Motion carried:   Aye:  4, Nay:  0.

 

Equipment Review – Police Department:

 

Merl Page reported Chief Baker requested specialized equipment for active shooter training in the amount of $4500. This was not a budgeted item. However, the funds were available. Commissioner Weixelman, seconded by Commissioner Baughman, moved to approve the purchase of specialized training equipment in the amount of $4500.  Motion carried:   Aye:  4, Nay:  0.

 

Dog Park Signage:

 

The City Manager showed the Governing Body two options, one being horizontal and the other vertical, created by the girl scouts for the proposed dog park. The Governing Body unanimously chose the horizontal signage.

 

KDHE Investigation Agreement Review:

 

The Assistant City Attorney reminded the Governing Body of the ongoing investigation and monitoring by KDHE of sites within the City, including an area around the current City shop.   KDHE has requested to work only with the City moving forward and Caterpillar has agreed to assist with cost of continued monitoring. It is the City Attorney’s recommendation to authorize the City to sign an agreement with Caterpillar, contingent upon KDHE approval. Commissioner Baughman moved to authorize the City to sign an agreement with Caterpillar contingent on KDHE approval.  Commissioner Weixelman seconded the motion. Motion carried:   Aye:  4, Nay:  0.

 

Well Perfecting Extension:

 

The City Manager reported that the perfection process for Well #10 was this December.  He explained that since TCE was discovered at the old Atlas Missile Base, the City has reduced its pumping rate.  He suggested requesting an extension due to the modified pumping of Well #10.  Commissioner Baughman moved, seconded by Commissioner Beem, to file for an extension based on the statutory limits.  Motion carried.  Aye:  4, Nay:  0.

 

City Manager and Other Reports:

 

Merl Page reported the parking project on Ash Street has been completed. The intersection of Columbian Rd and 4th Street (Military Trail) has been opened with the pouring on the south side of 4th Street to begin shortly, weather permitting. The INFRA grant will not be moving forward, however the City will continue to work with the consultants on other grant opportunities. The City Treasurer and City Manager will be meeting with Commerce Bank later in the month to schedule paying off the lease purchase for the power plant in order to save roughly $55,000 in interest.
