City Commission Minutes 07/05/2017

 

Regular Meeting:

 

The Governing Body of the City of Wamego, Kansas, met in Regular Session on Wednesday, July 5, 2017, at 6:00 P.M. in the City Commission Chambers at 430 Lincoln Avenue, Wamego, Kansas. Those present were: Mayor William Ditto; Commissioners: Richard Weixelman, Robert Morse Jr., Clifford Baughman and Thomas Beem.

 

Also present were:  City Manager, Merl Page, City Clerk, Shanda Jahnke and Assistant City Attorney, Jake Pugh.  

 

The City Clerk presented the minutes of the regular meeting of the Governing Body held on June 20, 2017.  After a careful reading and discussion thereof, it was moved by Commissioner Baughman and seconded by Commissioner Morse to approve the minutes as presented.  Motion carried.  Aye: 5, Nay: 0. 

 

The City Clerk then submitted to the Governing Body for their consideration and approval Appropriation Ordinance No. 1528.  After a careful review and discussion thereof, Commissioner Beem moved, seconded by Commissioner Baughman, to approve and adopt Appropriation Ordinance Number 1528.  Motion carried.   Aye: 5, Nay:  0.

 

Public Comments and Communications:

 

Mayor Ditto called for a regular work session on Tuesday, July 18, 2017 at 4:30 P.M.

 

Public Hearing – Easement Vacation:

 

Richie Chrest was present to request the City vacate approximately one (1) foot of the City easement at 1409 Poplar Street. According to Mr. Chrest he needs the additional foot of the easement for the soffit of the house he is building. Commissioner Morse moved to grant the one (1) foot easement vacation at 1409 Poplar Street. Commissioner Beem seconded the motion. Motion carried. Aye: 5, Nay:  0.

 

Housing Authority Request:

 

Cheryl Swenson, Atchison Housing Authority, was present to request assistance in paying attorney’s fees for a lawsuit involving multiple housing authorities. The suit will assist in getting monies owed to the housing authorities from HUD. The housing authorities have already won one round of hearings. Commissioner Morse moved to authorize payment of $1,000 to the Atchison Housing Authority on behalf of the Wamego Housing Authority to participate in a class action lawsuit again HUD. Commissioner Weixelman seconded the motion. Motion carried. Aye: 5, Nay:  0.

 

Utility Billing Question – Donna Hobbs:

 

Donna Hobbs was present to discuss being reinstated on the budget (level payments) plan after a delinquent termination of the plan. After a lengthy discussion, Commissioner Morse moved to allow terminated budget utility customers to have the plan reinstated at the customer’s request in July or January following a termination. Commissioner Baughman seconded the motion. Motion carried. Aye: 5, Nay: 0.    

 

Drainage Improvement Review:

 

Merl Page reported two proposals had been received for work to be done in the Morton Park area at 6th Street and Parkview. R.M. Baril’s proposal was for $48,715 and Bayer Construction’s proposal was for $52,190. The area in question is not owned by the City but by private citizens, however the drainage from the area is deteriorating the street. Commissioner Weixelman moved to authorize the City Manager to negotiate with the property owners for an easement on the entire parcel and accepting R.M. Baril’s proposal contingent upon the negotiations. Commissioner Morse seconded the motion. Motion carried. Aye: 5, Nay: 0.    

 

Proposals Review: -

 

The City Manager reported that proposals had been received for several projects. The results are as follows:

 

City Shop Painting – one proposal from Economy Carpentry for $13,785

4th & Elm – Drainage Inlet- one proposal from Construction, Inc. for $10,000

5th Street Sidewalk (N of City Shop) – three proposals – Economy Carpentry for $9,100, Kolde Construction for $8,470 and Construction, Inc. for $7,835.0

Storm Inlet Repair (Ash Street) – one proposal from Construction, Inc. for $6,200

 

Commissioner Beem moved to authorize signing contracts with Economy Carpentry for the City Shop painting project and Construction, Inc. for the 4th & Elm, 5th Street Sidewalk and Storm Inlet Repair projects. Commissioner Baughman seconded the motion. Motion carried. Aye: 5, Nay: 0.

 

Utility Customer Policy Review (lease agreements):

 

Merl Page advised the Governing Body of issues with utility customers putting utilities in their names for other individuals and the possibility of requiring potential customers to provide lease agreements. The Governing Body advised they would give the issue thought and consideration.

 

Contract Review – 4th Street Project:

 

The City Manager reported the contract for the 4th Street Project had been received for signatures. Commissioner Baughman authorized the Mayor and City Clerk to sign the documents contingent upon City Attorney review. Commissioner Beem seconded the motion. Motion carried Aye: 5, Nay: 0.

 

Pre-Eclipse Event- Recreation Complex:

 

Merl Page reported a request had been made by Jerelyn Ramirez to hold an information booth on the west side of the walking trail at the Recreation Complex on August 5th from 2:00 P.M. to 4 P.M. to educate on the upcoming eclipse. Commissioner Baughman moved to approve the request. Commissioner Weixelman seconded the motion. Motion carried. Aye: 5, Nay: 0. 

 

Ordinance  No.  1681 – Seat Belt Fines:

 

Ordinance No. 1681 was approved and read as follows:

 

AN ORDINANCE OF THE GOVERNING BODY OF THE CITY OF WAMEGO, KANSAS, AMENDING PARAGRAPH 14-101 OF THE CODE OF THE CITY OF WAMEGO, KANSAS, THE SAME INCORPORATING BY REFERENCE THE “2016 STANDARD TRAFFIC ORDINANCE FOR KANSAS CITIES,” 44TH EDITION, BY ADDING A NEW SUBPARAGRAPH (a) TO AMEND SECTION 182.1 OF SAID STANDARD TRAFFIC ORDINANCE; AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH.

 

Commissioner Baughman moved to approve Ordinance No. 1681. Commissioner Beem seconded the motion. Motion carried. Aye: 5, Nay: 0.

 

City Manager and Other Reports:

 

At this time the City Manager reported that the 4th Street Project was scheduled to begin on July 10th with phase one (1) being completed by August 28th.

 

The City Manager advised he received a contract from Evans Midland Empire to hold the 4th of July carnival in 2018 with the same terms, except they will run for 6 days. Commissioner Baughman moved to approve the contract with Evans Midland Empire for the 4th of July carnival for 2018. Commissioner Weixelman seconded the motion. Motion carried.   Aye: 5, Nay:  0.

 

A public notification referencing Pollution Control Permits was posted on the front bulletin board of the City Office.

 

The City monthly calendar was included in the meeting packet.
